Event Requirements Participants who fulfill the two requirements below during the event period below will receive event exclusive souvenirs:
  1. Finish the target distance in the category you have signed up for and upload your running record to Run2gather’s website or Run2gather apps; and
  2. Upload two photos taken at EAL stations (One must be taken at Exhibition Centre Station or Admiralty Station, while another one must be taken at any one EAL station in the New Territories and Kowloon) with your bib and the station name clearly shown (inside or outside the station are acceptable)
*For Team and Family group, one of the selfie must clearly show all members
Collection of Souvenirs and medals July 2022. Eligible finishers will be informed individually in due course.

Terms and Conditions

  1. The East Rail Line Cross Harbour Virtual Run (“Program”) is organised by MTR Corporation Limited (“ MTR” or “we”). All the Participants of the Program are herein referred to as “Participants” or “You”. Your participation and continued participation in the Program constitutes your agreement to comply with and be bound by the terms and conditions below and all the rules, regulations, guidelines and frequently asked questions (FAQs) published on the Program website from time to time (collectively “Terms and Conditions”).
    • Duplicate registrations will be counted as a single registration. Entry quota cannot be transferred to other applicants or events. Submitted application materials will not be returned.
    • You hereby acknowledge and confirm that any and all actions and/or decisions that you may make or conduct as a result of or in connection with the Program are exercised based on your own independent judgment and at your own risks. You acknowledge that you are joining this Program voluntarily and may terminate at any time.
    • To apply for the Team or Family category, one team/family member may submit the application for and on behalf of the other team/family members. By submitting the application, the applicant undertakes that s/he has obtained all the team/family members’ agreement to comply with and be bound by the Terms and Conditions.
    • For any Participant below 18 years of age, his/her parent/guardian’s consent is required for participation in the Program. By submitting the application, the applicant undertakes that s/he has obtained such consent.
  2. Whilst you are required to select one of the 5 specified distances which you target to complete for the Program (46km, 23km, 18km, 10km or 5km), you can decide you own route and can choose to complete the target journey in a single session or in separate and unlimited number of sessions according to your own physical strength. The suggested routes listed in the Program website are for reference only and are by no means compulsory or required. Please consult a doctor if you have any concern about your physical fitness prior to or during the Program. If you feel unwell, you should stop your exercise and seek medical consultation immediately.
  3. There are different target distances for different categories. The distances of 23 kilometers and 46 kilometers are longer and have a higher demand for physical fitness. All suggested routes are for reference only. Individual road sections include concrete roads, dirt roads, mountain trails and inclines. You can decide on a suitable route or complete the target distance in more than one session according to your personal experience, physical strength and personal safety.
  4. You are advised to plan the route thoroughly before each trip. You should avoid night trips. You should also avoid difficult sections which exceed your physical capability. You may conduct appropriate training to enhance your physical strength and endurance according to your physical state and capability. You should gather all related information before and bring along appropriate equipment and outfit for each trip to cater for your own physical needs and in case of emergencies or injuries. Please seek professional advice on all the above as needed.
  5. People who are pregnant or with chronic diseases, such as heart disease and high blood pressure, are not recommended to participate in the Program. MTR reserves the right to disqualify Participants who are physically not suitable for the Program.
  6. You are recommended to purchase your own personal accident insurance.
  7. Neither MTR or its affiliates make any representations or warranties of any kind, whether expressed or implied for or in relation to the Program and any souvenirs offered in the Program. MTR and its affiliates disclaim all representations, warranties and/or guarantees of any nature (including but not limited to merchantability, fitness for purpose, quality, availability, correspondence to description or sample, non-infringement, title, completeness, usefulness, accuracy, reliability, care and skills for service and/or time for service performance) to the maximum extent permissible by applicable law.
  8. MTR accepts no liability for any direct or indirect loss or damage (including any consequential, special or exemplary damages) arising from the participation in the Program or relating thereto, to the maximum extent permissible by applicable law.
  9. You hereby grant MTR a perpetual, irrevocable, sub-licensible and royalty-free licence to publish, display, edit, or otherwise use or exploit the photos you submit at any time or place in any manner and on any medium for the purposes related to the Program, including without limitation to promote the Program and for related publicity purposes during or after the Program. You warrant that you are the copyright owner of the photos or you are authorised by the copyright owner to submit the said photos to us and grant us the above mentioned licence; the photos and your submission do not infringe third party rights including without limitation copyright, and are free from encumbrances. You hereby waive and will procure the relevant parties to waive any moral rights in the photos (such as the right to be identified as the author).
  10. The Program period is from 15 May, 2022 00:00 (GMT +08) to 30 June, 2022 23:59 (GMT +08).
  11. The running records uploaded by you must clearly show the date, distance (in kilometers, only integer input is accepted) and duration of each run. Each upload record must be for a distance of at least 1 km.
  12. Medal and souvenirs will only be awarded to participants who complete the target distance and fulfill the event requirements during the Program period.
    • Participants who fulfill the event requirements can choose to collect their medal and souvenirs in person at "Run2gather" office or by delivery (if delivery is selected, the incurred fee will be paid by the Participants). If the medal and souvenirs are not collected within a designated period, they will be treated as void. For more details, please refer to the further notice which will be dispatched to the Participants after the Program period.
    • Participants who choose to receive the medal and souvenirs by delivery service will need to pay for the incurred delivery fee. Participants are also required to ensure the accuracy of the information provided. If any parcel is lost, damaged, or delayed due to incorrect information or problems in the courier process, MTR will not be held responsible nor will any souvenirs be reissued.
    • Participants who want to collect the medal and souvenirs in person must present a valid identification document for verification during collection. If a Participant is unable to collect the medal and souvenirs in person, s/he delegate must present an original authorization form signed by the Participant and a copy of the Participant's valid identification document in order to collect the medal and souvenirs on his/her behalf.
  13. Medals and souvenirs cannot be returned or exchanged for cash, nor can they be exchanged, transferred, resold or refunded.
  14. In case there is, in MTR’s opinion, any fraud relating to or abuse or suspected violation of the Program, ,MTR reserves the right to disqualify the Participants immediately and also reserves the right to take legal action without further notice.
  15. The medals and souvenirs of the Program may vary from time to time at the sole discretion of MTR without prior notice. Medals and souvenirs may be replaced by other products or services if they run out of stock. Medals and souvenirs images provided on the Program website are for your general reference only and we do not provide guarantee on this.
  16. Medals and souvenirs will not be reissued if they are lost or damaged after collection.
  17. Participants should ensure that all information submitted in their application is correct, complete and true. The provided names will be shown on the engraved medals, and MTR will not be responsible or accept any request to change the names on the medal.
  18. In order to participate in the Program, Participants are required to download, subscribe to the membership of, and use the website or mobile application of a third party service provider Joint Concept Dynamic Limited (“Run2gather”) [] for posting your running records, submitting your photos, tracking your rankings, and communicating for souvenir delivery/collection.
  19. Your use of Run2gather’s goods and services are subject to further terms and disclaimers (if any) from Run2gather [] You acknowledge that you are free to choose whether to join the Program and use the Run2gather goods/services, you are joining the Program and using the Run2gather goods/services voluntarily at your own risks and may terminate at any time. MTRCL shall not be liable or responsible for any Run2gather goods and/or services, any acts, omissions and/or contraventions (if any) of Run2gather, for your transactions with them, or otherwise for any matters that are outside of MTRCL’s control.You are responsible for handling and managing any queries and/or disputes that you may have for any Run2gather goods/services with Run2gather directly.
  20. No transmissions over the Internet can be entirely secure. Whether a Participant can join and complete the Program is subject to the device model used and network performance. MTR will neither guarantee the Program will operate smoothly, nor bear any legal responsibility for any souvenirs that are lost, delayed, not received or not redeemed due to any issues relating to system updates/maintenance, device model, network, technology, hacking, unsuccessful/delayed participation in or operation of the Program, and/or any other uncontrollable events. Souvenirs will not be reissued under any circumstances.

  22. In cases of any disputes regarding the Terms and Conditions result and any other matters relating to this Program, MTR reserves the right to final and binding decision.
  23. MTR may launch, revise, modify, suspend, cancel or terminate the Program or any aspects of it (including but not limited to the format, souvenirs given, etc.) at its sole discretion at any time without prior notice. Any changes or cancellation of the Program will be announced on the event website.
  24. If there is any discrepancy between the Chinese and English versions of the Terms and Conditions, the English version shall prevail. MTR reserves the right to revise and interpret the Terms and Conditions.
  25. MTR reserves the right to amend any of the Terms and Conditions at its sole discretion at any time without prior notice. The decision of MTR on all matters and disputes pertaining to the Program shall be final.
  26. The Terms and Conditions shall be governed by and construed in accordance with the Laws of the Hong Kong Special Administrative Region of the People’s Republic of China. You agree to irrevocably submit any disputes arising from or in connection with the Terms and Conditions and/or the Program to the exclusive jurisdiction of the courts of Hong Kong.
  27. The Contracts (Rights of Third Parties) Ordinance shall not apply to the Terms and Conditions.
  28. In case of any dispute, the decision of MTR shall be final and binding.

Privacy Policy Statement ("PPS")

1. Your privacy

MTR Corporation Limited ("MTRCL", "we ", "our " or "us") respects your legal rights of privacy when collecting, storing, using, processing and transmitting Personal Data and this PPS explains our privacy practices. We are legally required to comply with the Personal Data (Privacy) Ordinance (Cap. 486) of the Laws of the Hong Kong Special Administrative Region when collecting, holding, using and/or processing your Personal Data. In doing so, we will ensure compliance by our staff to the strictest standards of security and confidentiality.

Please read the following carefully to understand our policy and practices regarding how your Personal Data will be collected, treated and processed. By providing your Personal Data to us, you are consenting to this PPS and the collection, use, transfer, storage and processing of your Personal Data as described in this PPS.

If you are age 14 or below, you must ask your parent or guardian before providing any Personal Data to us.

If there is any inconsistency between the English and Chinese version of this PPS, the English version shall prevail.

2. Collection of Personal Data

Depending on the types of goods and/or services we provide to you, we may collect two basic types of data from you, “Personal Data” and “Non-Personal Data”:

"Personal Data" means any personally identifying data which we may collect from you when you seek product(s) and/or service(s) from us and include without limitation names; email and postal addresses;, phone number; .

“Non-Personal Data” includes aggregate and/or automatic information, which is data collected about the use of goods and/or services (including without limitation our websites and/or mobile applications), or about a group or category of users from which individual identities or other individually identifiable information has been removed. This PPS does not restrict or limit our collection, use and provision of Non-Personal Data.

2.1 Personal Data

The following are the common situations when we may collect and store your Personal Data, although these situations are not exhaustive:

  • registration for a membership, enjoying benefits or otherwise using our services as a member of our programmes, activities and/or other services;
  • using and/or browsing our websites and/or mobile applications;
  • using our products and/or services;
  • entry and/or participating in any of our promotional, marketing or advertising activities;
  • posting, uploading, creating or otherwise generating any content and/or information; and
  • request for customer service or other assistance in connection with our products and/or services.

2.2 Non-Personal Data

When you use our websites and/or mobile applications, we may keep an activity log that does not identify you individually and cannot be used to identify the identity of any particular user. Generally, we collect and store the following categories of Non-Personal Data:

  • information about your device that you use to access our websites and/or mobile applications. This information may include the device name, IP address, operating system and version, the type of network and mobile Internet browser you use, the browser’s type and configuration, the geo-location information and other unique device identifiers of the device, browsing preferences such as language settings and font size etc.; and
  • information about your use of the website and/or mobile application including without limitation the domain names you visit and the specific actions you take on the website and/or mobile application, the number of new or returning visits, statistics on the pages visited and referred, a reading history of the pages and sites you have visited and viewed, search terms used and search results, error and crash statistics, traffic data (such as time, duration and date of access).

The above Non-Personal Data are collected and used to measure traffic, gauge the popularity of various parts of our websites and/or mobile applications, to gain general knowledge about our audience and market our websites and/or mobile applications to advertisers with whom we may share summarized traffic data. We may also share to third parties (including without limitation to those specified under paragraph 4 below) these Non-Personal Data for customizing, enhancing, optimizing, maintaining and/or improving the quality of our websites and/or mobile applications, such as for determining the optimal screen resolution, language and font settings, etc. This Policy in no way restricts or limits our collection, use, handling and provision of Non-Personal Data.

3. Purposes for which we will use your Personal Data

The purposes for which we may use your Personal Data will vary depending on the type(s) of product(s) and/or service(s) you seek from us. Such purposes will be stated in the Personal Information Collection Statement (“PICS”), application form, terms and conditions, mobile application and/or webpage relevant to your provision of Personal Data to us. If you fail to supply the Personal Data required, we may be unable to provide the specific products / services in full to you.

4. Disclosure and Transfer of Personal Data

In cases where we do collect Personal Data from you, we will:

(i) tell you (by way of a PICS or by a separate notification) that we are doing so and any purpose of use that we will make of such Personal Data we collect; and
(ii) where relevant, give you the opportunity to object to particular use of your Personal Data.

We will take all practicable steps to keep your Personal Data confidential but we may disclose, transfer and/or assign such data to the following parties:

(i) if MTRCL decides to sell, merge and/or re-organise any part of its business, to any actual or proposed assignee, transferee or successor of or to MTRCL's rights in respect of your Personal Data;

(ii) any agent, adviser, auditor, contractor or third party service provider who provides administrative, telecommunications, computer, payment, fraud prevention, insurance, data processing and/or other services to us in connection with the operation of our business and/or the relevant product(s) and/or service(s) that you seek from us, and/or who otherwise processes Personal Data for and on our behalf; and

(iii) any person (including without limitation government authorities, regulatory or administrative bodies or law enforcement agencies) to whom MTRCL is under an obligation to make disclosure under the requirement of any law binding on MTRCL or for the purposes of any guidelines or codes of practice issued by regulatory or other authorities with which MTRCL is expected to comply, or such parties who are authorized by law to request information from MTRCL.

We may also disclose and/or transfer your Personal Data in the manner as stated in the Personal Information Collection Statement and/or any terms and conditions relevant to the product(s) and/or service(s) you seek from us.

The parties to whom we disclose and/or transfer your Personal Data may be situated outside of Hong Kong where there may not be in place data protection laws which are substantially similar to, or serve the same purposes as, the Personal Data (Privacy) Ordinance.

5. Links to Other Websites

If you use our websites or mobile applications, there may be advertisements or hyperlinks linking to another website (e.g. Linked Sites). If you click on any of these advertisements or hyperlinks, you will leave our websites or mobile application for another location. At any other website, the protection of your privacy, Personal Data and your exposure to cookies are not our responsibility and you are advised to refer to the privacy policy of that other location (if any).

Some of our websites and/or mobile applications may allow you to link and/or connect to third party social networking sites. If you choose to link and/or connect to these third party social networking sites, we may be able to collect certain Personal Data from your social networking profile provided to us by the social networking site. In that case, we will collect and use such Personal Data only for the purpose of providing you with the connection to the social networking site.

6. Cookies

Some of our websites use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses "cookies” to help our websites analyze how users use those websites. A cookie is a small text file that is stored on your device (e.g. on your computer) when you visit or access a website. A cookie can be used to identify a computer or a mobile device. It, however, is not used to collect any personal information and do not recognize you personally. In other words, it does not have the function of identifying an individual user of our websites.

Within our websites, cookies are used to track the use of and monitor traffic on our websites, as well as to improve, customize and enhance your browsing experience, for example:

  • Strictly necessary cookies are used to indicate your active using of our websites and remember the information you have entered in a form or where applicable, details about a payment you want to make. Without them, the information would be lost every time you move to a new page;
  • Performance cookies are used to collect anonymous information about how you use our websites, such as which pages you visit on our websites. We use this aggregated information to improve our websites; and
  • Functional cookies are used to record information about choices you have made and to recommend contents of our websites that are relevant to you and your interests.

On some pages, we feature embedded “share” buttons or widgets that enable you to connect to other social networking sites such as Facebook and Instagram. These sites may set cookies which can identify you as an individual when you are logged in to their services. We do not control these cookies and you should check the relevant third-party website to see how your information is used and how to opt-out.

If you use or continue using our websites, you agree for us to set cookies. You may choose to reject all or some cookies at any time by changing the setting of your web browser on your device. However, if you choose to delete or restrict cookies, you will not be able to use some of the functions of our websites.

7. Security and Storage

Except as mentioned in paragraph 4 above, your Personal Data, however stored, will be accessed only by our employees or contractors who are authorised to do so. Where Personal Data is stored electronically, it will be kept on a secured server and will be encrypted and/or password-protected (or under some equivalent form of protection) and accessible only by authorised personnel of MTRCL or its contractors. The network transmission of Personal Data will also be protected by using the SSL protocol. Personal Data are treated as confidential information by MTRCL and all employees and contractors designated to handle Personal Data will be instructed to do so only in accordance with this PPS.

8. Use of Personal Data in legal proceedings

If it becomes necessary that we have to take action against you for any reason whatsoever including recovering from you any money you owe us, you expressly agree that the Personal Data provided by you can be relied upon in identifying and taking legal action against you.

9. Your right to access and correct Personal Data

You may at any time request access to and correct Personal Data relating to you in any of our records. You may also ask us to delete you or your Personal Data from any active mailing or distribution list. To exercise any of your rights, you could contact us at the address or email below marking your communication "Confidential ". In response, we may ask you to provide certain details about yourself so that we can be sure you are the person to whom the data refers. We are required to respond to your requests within 40 days. We may also charge you a reasonable fee for complying with any data access request.

10. Retention of Personal Data

Personal Data provided by you are retained for as long as the purposes and any directly-related purposes for which such data were collected continue. Once it is not necessary to use the Personal Data to fulfil such purposes (and directly-related purposes), they are then destroyed within a reasonable time unless their retention is required to satisfy legal, regulatory or accounting requirements or to protect the MTRCL's interests.
